Under Texas law, spouses have the right to enter into written property agreements both prior to and during their marriage.  These agreements are often structured to confirm the property each spouse owned prior to marriage.

Other issues which may be addressed include:

  • Alimony in the event of separation or divorce.
  • Property issues in the event of separation, divorce or death.
  • Contribution of income by each spouse during the marriage.

Prenuptial and postnuptial agreements can be critically important for second marriages where spouses have assets or liabilities.
